| The Administrative Services Division administers the Freedom of Information Act (FOIA) Program in compliance with 5 USC 552 (as amended), 32 CFR 518, DoD Directive 5400.7, and AR 25-55. The FOIA generally provides that any person has the right to obtain access to federal agency records. We are required to disclose records upon receiving a written request, except for records or portions of them that are protected from disclosure by the nine exemptions and one of three special law enforcement record exclusions of the FOIA. This right of access is enforceable in court. |
| What is a FOIA request? |
| A FOIA request is a written request for federal agency records, made by "any person" including a member of the public (U.S. or Foreign citizen), an organization, or a business. Requests may also be made through an attorney or other representative on behalf of "any person." |
| How long does it take to process a FOIA request? |
| We are required to respond to a FOIA request within 20 business days, excluding Saturdays, Sundays, and legal holidays. This time period does not begin until the request is actually received by the FOIA office that maintains the records sought. If a FOIA request cannot be answered within 20 working days, both DoD Directive 5400.7 and AR 25-55 contains a provision for providing an interim reply until a final answer can processed. |
| Submitting a FOIA request |
| When submitting a FOIA request, no special form is required. Requests must be in writing, either handwritten or typed. If you are requesting information about yourself, you must provide a notarized statement stating that you are the person you say you are. If it is not notarized, your request cannot be processed. This requirement ensures that private information about you will not be disclosed to anyone else. A FOIA request should include the following: 1. Indicate in your letter that the information sought is being requested under the Freedom of Information Act. 2. State your willingness to pay applicable fees (i.e., I am willing to pay fees up to XX dollars). 3. Describe the records you are requesting in enough detail so they can be located with a reasonable amount of effort (i.e., type of document, title, subject, date of creation, originator, and related information such as circumstances surrounding the event and approximate date). Please refer to �A Citizen�s Guide to Request Army Records� for the proper procedural requirements before submitting your request for Army records (see Links). The FOIA does not require Federal Agencies to answer questions, render opinions, or provide subjective evaluations. FOIA requests must ask for existing records. |
