Large Construction Activities

(Primary and Secondary Operators)

Construction Storm Water Program Construction Storm Water Program
A primarmy operator of a large construction activity must apply for coverage under the TPDES TXR150000 general permitand submit a Notice of Intent (NOI). Operators (primary or secondary) of these sites are required to complete the following:
  • Develop a Storm Water Pollution Prevention Plan (SWPPP)  according to the provisions of the TPDES TXR150000 that covers the entire site or all portions of the site for which the applicant is the operator. The SWPPP must be submitted to DPW-ENV for review within 5 days of receiving the notice to proceed.  The SWPPP must be approved, prior to commencing construction activities.
  • Submit a Notice of Intent (NOI) – Primary Operators only, using a form provided by the Texas Commission on Environmental Quality (TCEQ), at least 7 days prior to commencing construction activities if submitted by mail. If submitted electronically, the NOI must submit an NOI to the TCEQ prior to commencing construction activities. Primary operators must complete a Primary Operator Construction Site Notice (CSN) using a form provided by the TCEQ.
  • Secondary operators must complete a Secondary Operator Construction Site Notice (CSN) using a form provided by the TCEQ.
  • Post signed copies of the primary operator’s NOI at the construction site prior to commencing construction activities in a location where it is readily available for viewing by the public. The NOI must be maintained in that location until the completion of the construction activity.
  • Post copies of all operator’s CSNs at the main entrance of the construction site. The notice must list the general permit number (or a copy of the NOI), the name and telephone number of a representative for the operator, a brief description of the project, and the location of the SWPPP.
  • Provide copies of the signed and certified NOI and CSNs to DPW-ENV at least 14 days prior to the commencement of construction activities. Storm Water Pollution Prevention Plan (SWPPP)

  • Follow all provisions set forth in the Construction Site Storm Water Inspection Program Memorandum of Instruction (MOI)dated November 12, 2008.
  • Primary Operators must submit a Notice of Termination (NOT), using a form provided by the TCEQ when the site has reached Final Stabilization.
  • When the project has been temporarily stabilized and is being closed out call DPW-Environmental for a Final Closure Inspection at 254-287-6499.
  • Secondary Operators must date their CSN of when it was removed and notify the MS4 operator.
